Terms of Service

By downloading, installing, or using Dear Future Me (“App”, “Service”), you (“User”, “you”, “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the App.

These Terms constitute a legally binding agreement between you and VietByte Company Limited (“VietByte”, “we”, “us”, “our”).

Please also review our Privacy Policy and AI Policy, which are incorporated by reference into these Terms.

Minimum Age: 17 years old.

You must be at least 17 years of age to use Dear Future Me. By using the App, you represent and warrant that:

• You are at least 17 years of age.
• You have the legal capacity to enter into a binding agreement.
• If you are between 17 and 18, you have obtained parental or guardian consent where required by applicable law.
• Your use of the App does not violate any applicable law or regulation.

We implement an age verification gate during onboarding. If we discover that a user under 17 has registered, we will immediately terminate the account and delete all associated data.

To use Dear Future Me, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your account credentials.
• Promptly update your account information if it changes.
• Accept responsibility for all activity that occurs under your account.
• Notify us immediately of any unauthorized use of your account.

You may register using Apple Sign-In, Google Sign-In, or email authentication. You may only maintain one active account at a time.

Dear Future Me is a personal letter-writing application that enables you to:

• Write Letters: Compose letters to your future self using text, handwriting, voice recordings, and images.
• Seal Letters: Seal your letters for a chosen time period with AI-generated seal art.
• Open Letters: Open sealed letters when the seal period expires, accompanied by AI-generated reflections.
• Journal: Maintain a personal journal with text entries.
• Send to Friend: Share letters with other users via invitation.
• AI Features: Receive AI-generated reflections, seal artwork, and writing prompts.
• Writing Prompts: Access AI-generated and curated writing prompts for inspiration.

The App is available as a freemium service with optional premium features accessible through in-app purchases.

5.1 Your Content

You retain full ownership of all content you create within Dear Future Me, including but not limited to:

• Letter text and handwriting input
• Voice recordings
• Images and photographs
• Journal entries

Your content belongs to you. VietByte does not claim ownership of any user-created content.

5.2 Responsibility for Content

You are solely responsible for the content you create, store, and share through the App. You represent and warrant that:

• You own or have the necessary rights to use the content you submit.
• Your content does not infringe on the intellectual property rights of any third party.
• Your content does not violate any applicable law, regulation, or these Terms.

By using Dear Future Me, you grant VietByte a limited, non-exclusive, non-transferable, revocable license to:

• Store your content on our servers for the purpose of providing the Service.
• Process your content through AI services (Anthropic Claude API) solely to generate reflections, seal art, and writing prompts for your personal use.
• Transmit your content as necessary to deliver the Service (e.g., Send to Friend feature).
• Create backups of your content for data protection and disaster recovery purposes.

This license is strictly limited to providing the Service. We will not:

• Use your content for advertising or marketing purposes.
• Share your content with third parties except as described in our Privacy Policy.
• Use your content to train AI models or for any purpose beyond providing the Service to you.
• Sublicense your content to any third party.

This license terminates when you delete your content or your account.

Dear Future Me incorporates artificial intelligence features powered by Anthropic's Claude API. By using AI features, you acknowledge and agree that:

• Your letter content, mood selections, and date metadata may be processed by AI to generate reflections, seal art, and writing prompts.
• AI-generated content (reflections, seal art, writing prompts) is provided for personal enrichment and is not professional advice of any kind.
• AI outputs may not always be accurate, complete, or appropriate. You should not rely on AI-generated content for any critical decisions.
• You may opt out of AI features at any time through app settings without losing access to core letter functionality.

You agree NOT to use Dear Future Me to:

8.1 Prohibited Content

• Create, store, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene.
• Create, store, or share content depicting child sexual abuse material (CSAM) or exploitation of minors.
• Create, store, or share content that promotes violence, terrorism, or self-harm.
• Create, store, or share content that infringes on intellectual property rights of others.
• Create, store, or share content containing malware, viruses, or harmful code.
• Create, store, or share unsolicited commercial communications (spam).

8.2 Prohibited Conduct

• Attempt to gain unauthorized access to the App, other user accounts, or our servers.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
• Use the App for any commercial purpose without our prior written consent.
• Circumvent, disable, or interfere with any security features of the App.
• Use automated systems (bots, scrapers, etc.) to access the App.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use the App in any manner that could damage, disable, overburden, or impair our servers or networks.
• Share your account credentials with any third party.

8.3 Enforcement

We reserve the right to:

• Remove or disable access to any content that violates these Terms.
• Suspend or terminate accounts that violate these Terms.
• Report illegal activity to appropriate law enforcement authorities.
• Cooperate with law enforcement investigations as required by law.

9.1 Premium Plans

Dear Future Me offers the following premium subscription options:

Prices are in USD and may vary by region due to App Store/Google Play pricing tiers. Prices are subject to change with prior notice.

9.2 Auto-Renewal

• Monthly and Annual subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period.
• Your Apple ID or Google Play account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel subscriptions through your Apple App Store or Google Play Store account settings.

9.3 Payment Processing

• All payments are processed by Apple (App Store) or Google (Google Play).
• VietByte does not collect, store, or process your credit card or payment method information.
• Refund requests must be directed to Apple or Google in accordance with their respective refund policies.

9.4 Free Tier

The free tier of Dear Future Me provides access to core letter-writing functionality with certain limitations. We reserve the right to modify the features available in the free tier with prior notice.

9.5 Trial Periods

If we offer a free trial:

• You will not be charged during the trial period.
• If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.
• Trial eligibility is limited to one trial per Apple ID or Google account.

The “Send to Friend” feature allows you to share a letter with another person. By using this feature:

• You confirm that you have the recipient's consent to send them a letter.
• You accept that once a letter is sent, it cannot be recalled or unsent.
• You are solely responsible for the content you send to others.
• The recipient will receive a notification and can choose to accept or decline the letter.
• VietByte is not responsible for any consequences arising from content shared between users.

11.1 VietByte's Intellectual Property

The App, including its design, code, features, branding, logos, and all related intellectual property, is owned by VietByte Company Limited and protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App without our express written permission.

11.2 AI-Generated Content

• AI-generated reflections are provided for your personal use and are not independently copyrightable by VietByte.
• AI-generated seal art created for your letters is licensed to you for personal, non-commercial use.
• You may not use AI-generated content for commercial purposes without our prior written consent.

11.3 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant VietByte a non-exclusive, worldwide, royalty-free license to use such feedback for any purpose, including improving the App.

The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the App will be uninterrupted, error-free, secure, or free of viruses.
• Warranties regarding the accuracy, reliability, or completeness of AI-generated content.

Dear Future Me is a personal letter-writing application and does not provide professional, medical, psychological, legal, or financial advice. AI-generated reflections are for personal enrichment only and should not be relied upon for any critical decisions.

To the maximum extent permitted by applicable law:

• VietByte's total liability for all claims arising from or related to these Terms or the App shall not exceed the greater of (a) the amount you paid to VietByte in the 12 months preceding the claim, or (b) $50 USD.
• In no event shall VietByte be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

VietByte is not liable for:

• Loss of content due to technical failures, server outages, or data corruption.
• Any actions taken based on AI-generated reflections or content.
• Content shared by users through the Send to Friend feature.
• Unauthorized access to your account resulting from your failure to secure credentials.
• Service interruptions due to maintenance, updates, or circumstances beyond our control.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless VietByte, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use of the App.
• Your violation of these Terms.
• Your content that infringes on any third party's rights.
• Your violation of any applicable law or regulation.

15.1 Termination by You

You may delete your account at any time through: Settings > Account > Delete Account.

Upon account deletion:

• All your personal data will be permanently deleted within 30 days.
• Active subscriptions must be canceled separately through Apple/Google.
• Data required for legal compliance may be retained for the legally mandated period.

15.2 Termination by VietByte

We may suspend or terminate your account if:

• You violate these Terms or our policies.
• Your account is involved in illegal activity.
• Your account has been inactive for more than 24 months (with prior notice).
• We are required to do so by law or court order.
• We discontinue the Service (with at least 30 days' prior notice and data export opportunity).

15.3 Effect of Termination

Upon termination:

• Your right to use the App ceases immediately.
• We will delete your data in accordance with our Privacy Policy.
• Sections of these Terms that by their nature should survive termination will survive (including Sections 5, 12, 13, 14, and 17).

We may modify these Terms from time to time. When we make material changes:

• We will update the “Last Updated” date.
• We will notify you via in-app notification at least 14 days before the changes take effect.
• Your continued use of the App after the effective date constitutes acceptance of the modified Terms.
• If you do not agree with the modified Terms, you must stop using the App and delete your account.

17.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Socialist Republic of Vietnam, without regard to its conflict of law provisions.

17.2 Dispute Resolution

Any dispute, controversy, or claim arising from or relating to these Terms shall be resolved as follows:

1. Informal Resolution: The parties shall first attempt to resolve the dispute through good-faith negotiation for a period of 30 days from written notice of the dispute.
2. Mediation: If informal resolution fails, the parties shall submit the dispute to mediation administered by the Vietnam International Arbitration Centre (VIAC).
3. Arbitration: If mediation fails, the dispute shall be finally settled by arbitration administered by VIAC under its rules. The arbitration shall be conducted in Ho Chi Minh City, Vietnam, in the English language.

17.3 Exceptions

• Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
• Users in the EU/EEA may bring claims in their local courts as permitted by applicable consumer protection laws.
• Users in California may have additional rights under California law.

17.4 Class Action Waiver

To the extent permitted by law, you agree that any disputes shall be resolved on an individual basis and not as part of any class, consolidated, or representative action.

18.1 Entire Agreement

These Terms, together with the Privacy Policy and AI Policy, constitute the entire agreement between you and VietByte regarding the App.

18.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

18.4 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. VietByte may assign its rights and obligations without your consent.

18.5 Force Majeure

VietByte shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or internet disruptions.

18.6 Language

These Terms are available in English and Vietnamese. In the event of a conflict between language versions, the English version shall prevail.
